"Do I need an ITIN to start my US LLC?"

It's one of the most common questions we hear from Indian founders, and the honest answer surprises many people: usually, no.

Plenty of founders pay for an ITIN they'll never use. Others skip it when they actually need one, then get stuck when the IRS rejects a tax return. This guide explains exactly when an ITIN for a non-resident LLC owner is necessary, when your EIN is enough, and how to apply the smart way from India.

What Is an ITIN?

An Individual Taxpayer Identification Number (ITIN) is a 9-digit tax ID the IRS issues to individuals who need to deal with the U.S. tax system but can't get a Social Security Number. It always starts with the number 9.

The key word is individual. An ITIN identifies you, the person. It doesn't identify your company.

ITIN vs EIN: The Difference That Matters

This is where most of the confusion comes from:

  • EIN (Employer Identification Number): identifies your LLC. You need it to open a business bank account, hire, file the LLC's tax forms and work with payment platforms.
  • ITIN: identifies you personally for your own U.S. tax filings.

You can get an EIN without an ITIN or SSN. Our guide on whether you can get an EIN without an SSN walks through exactly how non-residents apply.

Do You Need an ITIN as a Non-Resident LLC Owner?

You Usually Don't Need One If...

  • You own a single-member LLC taxed as a disregarded entity
  • Your LLC files Form 5472 with a pro forma Form 1120, which doesn't require the owner to have an ITIN
  • You run a remote service business from India, and you have no U.S. income tax return to file personally

That describes most Indian freelancers, agencies and SaaS founders. Your EIN does the work. Our Form 5472 and 1120 filing guide explains what that yearly filing involves.

You Likely Do Need One If...

  • You must file a personal U.S. tax return (Form 1040-NR), for example because your income is treated as effectively connected with a U.S. trade or business
  • You're a member of a multi-member LLC taxed as a partnership with U.S. tax obligations passed through to you
  • You're claiming certain tax treaty benefits where the IRS requires a U.S. tax ID
  • A bank, payment platform or credit card issuer specifically asks for a personal U.S. tax ID and won't accept your passport instead

If you're unsure which group you fall into, our US LLC tax guide for Indian founders explains how your LLC is taxed, which usually answers the question.

Common mistake: Applying for an ITIN "just in case." The IRS generally expects a real reason, often a tax return attached to the application. Without one, your application can be rejected.

How to Apply for an ITIN

Step 1: Complete Form W-7

Form W-7 is the ITIN application. You'll choose the reason you need an ITIN and enter your personal details exactly as they appear on your passport.

Step 2: Attach Your Tax Return (or Qualify for an Exception)

Most first-time applicants must attach the U.S. federal tax return that requires the ITIN, such as Form 1040-NR. A few exceptions apply, for example certain treaty or withholding situations, and those need supporting documents instead.

Step 3: Prove Your Identity

Your passport is the strongest document, because it proves both your identity and your foreign status on its own.

Step 4: Submit Your Application

There are three ways to submit:

  1. By mail to the IRS ITIN office in Austin, Texas, with your original passport or a copy certified by the agency that issued it
  2. In person at an IRS Taxpayer Assistance Center in the U.S.
  3. Through a Certifying Acceptance Agent (CAA), an IRS-authorized professional who verifies your passport, so you don't need to mail it

Pro tip: For founders in India, a CAA is usually the best option. Mailing your original passport overseas for weeks is risky, and certified copies from the issuing agency are hard to arrange. A CAA verifies your documents and submits the application for you.

How Long Does It Take?

The IRS currently quotes about 7 weeks for a complete application, plus extra time for international mail. Processing has been slower during the 2026 filing season, so plan ahead, especially if your ITIN is tied to a tax deadline.

You'll receive your ITIN by mail in an IRS notice. Keep it safe with your company records.

Don't Let Your ITIN Expire

An ITIN isn't permanent. If you don't use it on a federal tax return for three consecutive years, it expires on December 31 of the third year.

If your ITIN expires and you need it again, you'll have to file Form W-7 to renew it. Renewal applications go through the same processing queue, so renew early rather than at tax time.

ITIN, Banking and Payment Platforms

Many founders assume they need an ITIN to open a U.S. business bank account. In most cases, you don't. Business accounts like Mercury and Wise typically rely on your LLC's EIN and your passport. Our guide to the best bank account for non-US founders compares the options.

Where an ITIN helps is with personal U.S. financial products, such as some credit cards, that need a personal tax ID.

Get the Right Tax ID, Not an Extra One

The right answer depends on how your LLC is structured and how you earn your income. FormLLC helps you figure out whether you actually need an ITIN, and if you do, our ITIN Assistance service handles Form W-7 so you never have to mail your passport abroad.
